Maximano Silva, 32, most recently of 77 Huntington Ave., Marlborough, is accused of producing a rubber stamp in the name of a local physician and fake blank prescription forms also in the name of the physician. Silva allegedly generated health insurance cards and credit cards in the names of unknowing persons.
According to the indictment, returned late Thursday, he enlisted the aid of coconspirators to use fake identification in presenting the forged prescriptions for OxyContin, Klonopin and Percocet at pharmacies throughout the west of Boston area. The co-conspirators were instructed to submit the bogus health insurance and credit cards for payment for the highly potent controlled substances.
The bogus prescriptions were also presented at pharmacies in Hudson, Westborough, Framingham, Waltham, Watertown, Norwood and Sudbury.
In another aspect of the conspiracy, the indictment charges, Maximano drove with his 57-year-old father and co-conspirator Jose DaSilva of Hudson, to various doctors' offices, where they claimed Jose had a legitimate medical need for controlled substances. They allegedly provided the victimized doctors with false home addresses.
The father and son, and daughter-in-law Crystal Silva, 31, of 77 Huntington Road, Marlborough, subsequently presented the prescriptions and refills at various pharmacies where fraudulent health care and credit cards were offered as payment. Proceeds from sales of the drug were used to pay co-conspirators and for the alleges.
