GREENEVILLE—A judge has ordered a psychological evaluation for a Church Hill man being held on federal weapons charges.
Dana Preston Gregory, 50, 455 Devault Street, Church Hill, was indicted in August on charges of being a convicted felon in possession of more than 200 assorted firearms, including a machine gun.
According to court documents Gregory, who is being held without bond, was transferred October 12 to a federal medical facility in Lexington, Kentucky for the evaluation.
Gregory's attorney, David Leonard, said he requested the evaluation “based on his (Leonard's) observations” of his client's behavior, and in light of the seriousness of the firearms charges and possible drug trafficking charges Gregory may face.
Inman's ruling states he was granting the motion for a mental evaluation based on Leonard's affidavit describing Gregory's conduct, although the affidavit was sealed by the court.
“This is not to say that the observations themselves reflect reality, inasmuch as Mr. Gregory in the past has manifested manipulative behavior and could be feigning his symptoms,” the motion notes.
Court documents state several law enforcement agencies, including the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), Tennessee Bureau of Investigation (TBI), Hawkins County Sheriff's Department, Church Hill Police Department and Sullivan County Sheriff's Department were involved in an investigation into possible illegal activities for several months before a search warrant was executed at his Devault Street residence on July 12.
“During the course of the search, agents found eleven firearms around the couch and television area of the residence which Gregory occupied alone. Five additional firearms were found hidden throughout the residence. Most of the firearms were fully loaded,” the criminal complaint states.
The document also states authorities found what was described as a fully automatic Iver Johnson M-1 .30 caliber machine gun.
The indictment lists 206 individual weapons authorities reported seizing on the July 12 raid at Gregory's home and a subsequent July 15 search of a storage unit Gregory reportedly rented.
In addition to the machine gun authorities said they recovered 66 rifles, 60 shotguns, 43 semiautomatic pistols, 33 revolvers and three Derringers.
The court order states the psychological evaluation should be completed within 30 days and a report filed with the court indicating whether or not Gregory is competent to stand trial.
