Oxycontin robber sentenced to prison...

Submitted by admin on Fri, 2007-04-27 15:53.

A Brownsdale man who admitted to robbing an Austin pharmacy on Halloween last year got about three years in prison Thursday.

Judge Fred Wellmann gave credit for time served by Clayton, who has been in custody since Nov. 1, when authorities arrested him at an Austin home for the robbery.

Clayton, who declined to make a statement at sentencing, admitted in February to entering the ShopKo pharmacy the morning of Oct. 31 in northwest Austin and pretending to have a weapon while robbing the store of prescription pain-relievers.

In his plea, Clayton admitted to threatening he had a sawed-off shot gun and passing a note to a pharmacy employee advising the person not to try to be a "hero." He also acknowledged giving some of the stolen drugs to another man.

Clayton also admitted during the same hearing in February to selling Oxycontin on May 11 to an Austin police informant.

In the robbery complaint, ShopKo employees told police the suspect fled on foot with more than 200 tablets containing the drug oxycodone, which is in the prescription drug Oxycontin.

The employee did not see what was under Clayton's shirt but thought it was either a gun or a pipe. The employee then placed six to eight bottles of oxycodone pills in a plastic bag.

During a search of Clayton's residence, authorities found 121 Oxycontin tablets.

In a police interview, Clayton, who had been free on bail for the drug-sale case, told authorities he had put an 18-inch broomstick handle under his sweatshirt to make it look like he had a firearm.
